As Data Controller, Bigben Interactive ("We", "Us", "Our", "Bigben"), a Bigben group company with its registered office at 396-466, rue de la Voyette – CRT 2 – 59273 Fretin, France, collects the personal data of Users and Customers (hereinafter the "Data") of the website https://www.bigben.eu (hereinafter the "Site").

Our Privacy Policy aims to inform you of Our practices regarding the collection, use, and sharing of the Data that you may provide to us through the Site or Our mobile applications in order to benefit from the proposed services (hereinafter the "Services").

  • Users shall mean any internet user who browses one of the Sites and has created an online account on the Platform to become a Bigben Member.

  • Customers shall mean any User who has created an account and places an order on the Site to purchase a product or subscribe to the Services.

If you are a minor, you must register as a member or access the Sites and its Services only after your parents (or guardian) have read our Privacy Policy. As the processing of your Data is carried out within the scope of Bigben's activities in the territory of the European Union, the General Data Protection Regulation 2016/679 (or "GDPR") applies, whether or not the processing takes place within the European Union. Data you provide to us:

  • Your email address and your country/region when you register or log in to your Bigben member account. If you use a social media account to log in or create a Bigben member account to use Our Services, any publicly available Data (including, but not limited to, your profile picture, gender, date of birth, and language settings) associated with your social media account may also be collected by Us, subject to your consent.
  • Your email address when you subscribe to the Site's newsletter.
  • Information provided when you complete your account on the Site, namely: Your name, first name, date of birth, country, language, contact/delivery/billing address (including postal code), contact information, email address. If you do not provide us with this Data, you will not be able to use the Services.

Data relating to your orders that we collect during your purchases on the Sites (it being specified that creating an account is mandatory to order on the Sites):

  • Your name, first name, email, postal address, country, language, date of birth, purchase history, registered product(s), and wishlist.

Data relating to the use of the Services collected by our technical partners:

To place / read trackers and analyze your browsing on the Sites. The consent of Customers and Users to cookies on the Sites.
To respond to our legal or regulatory obligations applicable to the Site's activity, made notably by public authorities,

Recipients of your Data

To enable Bigben to fulfill the purposes stated above, your Data may be sent to the following recipients:

    • Logistics Department
  • Service providers, suppliers, and subcontractors who participate in the provision of the Services (including the company GAMES.FR, a subcontractor in charge of processing orders placed on the Sites, as well as the Site's host and service providers who help us send marketing communications, contribute to customer support, delivery of purchases, and billing).   • BIGBEN Group companies (in particular BIGBEN CONNECTED, GAMES.FR, NACON, and METRONIC) for Customer database management.

We will also share your Data outside the BIGBEN Group with third parties only with your consent:

  • Business partners: We transmit your Data, once anonymized, to Our business partners, including Our business partners who provide data analysis services or advertising and marketing communications based on aggregated and anonymized information.

Locations of Your Data Processing

Your Data collected and processed within the framework of the Services is primarily stored in the European Union. Bigben undertakes to take all appropriate protection measures in the event of a transfer of your data outside the European Union (implementation of the European Commission's standard contractual clauses or an adequacy decision for the site host Google "Digital Privacy Framework").

Retention Period of Your Data

Your collected Data will be kept for the entire period necessary to accomplish the purposes above, plus the legal prescription period. Your data collected upon your registration will be kept for the entire duration of your relationship with Bigben. It may then be kept and processed for 3 (three) years from the end of the commercial relationship (for example, from a purchase, the expiry date of a warranty, or the last contact from you) to allow us to send you commercial solicitations, subject to the withdrawal of your consent where it was required or the exercise of your right to object. Protection of Minors

Each User must provide their age when registering for the Services. Deletion of the BIGBEN Member Account

At any time, you can delete your account on the Platform. We draw your attention to the fact that once your account is deleted, you will no longer have access to your history or to any information that made up the account in question.

Modification of the Privacy Policy

We may make changes to Our privacy policy from time to time. We recommend that you regularly consult the Privacy Policy posted on the Sites. By accessing or using Our Services after the Privacy Policy has been updated, Bigben will consider that you have taken note of the terms of the Privacy Policy, including updates. The most recent version of the Privacy Policy will always be available on this page. In the event of a significant change, you will be sent a notification by e-mail.
